1. Acceptance of the Terms

By accessing and using our website, including its information, features, functionality, and tools, with or without availing the MyLingoTrip "service" or "services," you agree to be bound by the following Arrangement and Terms. Whether you are a "visitor" (simply browsing our website) or a "customer" (having registered with MyLingoTrip), these Terms apply to you. Throughout this document, "you" or "user" refers to both visitors and customers, while "we" refers to MyLingoTrip. The term "material" encompasses all class material used in your classes. In the event that you wish to become a customer, you must express your intent to other customers and/or utilize our service/services. However, prior to registration, it is essential that you carefully read and acknowledge your acceptance of MyLingoTrip's terms and conditions.

If, for any reason, you do not agree with any of the terms and conditions presented here, we kindly ask that you refrain from using the MyLingoTrip website and/or services.

To ensure a clear understanding of your rights and obligations, we urge you to thoroughly review all the terms and conditions before proceeding to use the MyLingoTrip website and/or services.

2. Changes to these Terms

MyLingoTrip reserves the right to modify or update these terms and conditions at any time. Any changes will be effective immediately upon posting on the website. Your continued use of the Site following notice of the Agreement modification will be considered an acceptance of the modified terms and conditions of use. Albeit, if major implications are applied (contract-wise), you will be asked for providing your electronic signature. Your alternative upon dissatisfaction with the modified terms of use is to cancel your subscription. Moreover, MyLingoTrip reserves the right to modify, suspend or discontinue the Site at any time.

 

3. User Responsibilities, conduct, and IPR

All users agree to utilize MyLingoTrip's services solely for lawful purposes and in compliance with all applicable laws and regulations. You are responsible for maintaining the confidentiality of your account credentials and for any activities or actions that occur under your account. You shall not engage in any unauthorized access, use, or distribution of any content or information available on the MyLingoTrip website. You agree not to engage in any activity that may disrupt or interfere with the proper functioning of the website, including but not limited to transmitting viruses, spamming, or engaging in any form of hacking or unauthorized access.

All registered users agree not to post, distribute, publish or by any other means convey offensive material, including discourteous language, photographic material, or any other kind of material of an offensive or sexual nature. Violation of this agreement conditions by any user will result in termination of that users’ registration and will result in notifying the authorities and possibly taking legal action.

All registered users agree not to post, distribute, publish, or by any other means place any computer code on the MyLingoTrip website, which directly or indirectly links to another Site without our express consent.

All registered users agree not to distribute or share their username and /or password details with any other individual or company to provide to other individuals the permission to utilize the services provided through the MyLingoTrip website.

The content provided on the MyLingoTrip website, including but not limited to text, graphics, logos, images, videos, and software, is the intellectual property of MyLingoTrip and protected by copyright laws. You may not reproduce, distribute, modify, or create derivative works of any content on the website without prior written permission from MyLingoTrip.

All registered users self-certify that they can form legally binding contracts under their applicable regime of their country of residence.

 

4. Access and Interference

By registering on the MyLingoTrip website, you agree to abide by the following policies: 

Automated Data Gathering: You shall not utilize any robot, spider, scraper, deep link, or similar automated tools, programs, algorithms, or methods to access, acquire, copy, or monitor mylingotrip.com or any part thereof without the express written consent of MyLingoTrip. Such consent will be granted or withheld at the sole discretion of MyLingoTrip. 

Unauthorized Navigation and Search: You shall not use or attempt to use any engine, software, tool, agent, or other device or mechanism (including, but not limited to, browsers, spiders, robots, avatars, or intelligent agents) to navigate or search the MyLingoTrip website, except for the search engines and search agents available through the service or generally available third-party web browsers (such as Microsoft Explorer). 

Malicious Software: You shall not post or transmit any files containing viruses, worms, Trojan horses, or any other contaminating or malicious software/features that may interfere with the proper functioning of mylingotrip.com and/or its services. 

Software Reverse-Engineering: You shall not attempt to decipher, decompile, disassemble, or reverse-engineer any software incorporated within or forming a part of mylingotrip.com and/or its services.

5. Student Registration

When registering as a student at MyLingoTrip, you will be required to provide personal information not limited to your preferred username and password; your email address; the language of your choice; your country of residence; your local currency and local time zone. By registering an account at mylingotrip.com, you automatically confirm that you accept the terms and conditions of use. All language students agree to the use of their personal information following the web site privacy policy.

 

6. Students – Booking and Payment Policy

 

Upon submitting the required fee through the MyLingoTrip website, the platform will promptly issue a receipt to the student for the corresponding amount of the order. It is the responsibility of MyLingoTrip to ensure that students receive the appropriate receipt for their payment. Note that students are only required to make a single payment. All transactions will be conducted in the local currency (Euros). 

It is strictly prohibited for students to engage in any action or attempt to evade the payment of fees in accordance with the MyLingoTrip booking policy. Additionally, arranging or attempting to arrange lessons outside the MyLingoTrip platform is also strictly prohibited. Violation of these policies will result in the closure of the student's account, and legal action may be pursued to recover any outstanding amounts. MyLingoTrip reserves the right to modify or adjust these fees at any time. The prices displayed on mylingotrip.com include all applicable fees.

Students now have the option to extend the duration of their packages by purchasing the equivalent option (1 month, 2 months, or 4 months). This means that they can easily prolong their language learning experience by selecting the appropriate extension. There is also the option to “Freeze” a course.

7. Students – Fees and Cancellation Policy

You will be required to register and create an account with MyLingoTrip (the “Account”) to have access to the website’s services. Information gathered through the registration process and information related to your account will be subject to these terms as well as to our “Privacy and Security Policy.” You warrant that the information provided for the creation of a student’s account is truthful, accurate, and complete and that this information will stay truthful, accurate, and complete as long as you are registered at the MyLingoTrip website.

Certain material and functionalities of the website are available only after the purchase of an online language package (the Package options). According to this Agreement, you are responsible for any charges associated with registering to the website. MyLingoTrip reserves the right to change the price of the actual package fees or institute new fees at any time, upon reasonable notice posted on the website and emailed to current customers.

By purchasing a Study Package, you agree to be bound to the following terms:

MyLingoTrip ensures that every bank/credit card/PayPal/Revolut transaction you make is 100% secure. If you wish to check on the status of your subscription (on-going, expired,etc), please log in and visit the “My Account” page in your Login area.

All language courses fees are recurring and non-refundable after your purchase. If you do not wish to continue studying at MyLingoTrip, you have to deactivate your account at the “My Account” page at your login area or provide us with a written (email) notice.

An exception to the prior paragraph is our “7-day money-back guarantee”. Within seven days after the purchase of a study package, you have the right to cancel your language course and receive a full refund by providing us with a written (email) notice.

Lesson packages booked and not used within the expiration date will be canceled and will not be refunded. 

In case of a cancellation: A scheduled lesson with a teacher has to be canceled specified hours before the actual appointment for the lesson. Otherwise, the arranged hour is going to be deducted from the purchased lesson-package, without any further announcement or refund. This is solely contigent upon the Package the student have chosen. For groups of 2 or more: In case one of the students cancels the lesson but the other one attends it, the hour will be charged as usual and no extra private lesson will be provided for the student who missed the lesson.

 

Free Trial Lesson:
The free trial is available only to first-time users of the MyLingoTrip website.

Note: If for a well-explained reason the student is not satisfied, he/she/they are granted with another Free Trial with a different tutor (at least once per student), after discussing each case with the initially allocated tutor.

8. Indemnification

You agree to indemnify, defend, and hold harmless the MyLingoTrip platform, its affiliates, partners, and employees from any liability, claims, costs, or damages arising out of your use of the MyLingoTrip website and/or your breach of this Agreement, as outlined in the terms and conditions set forth herein. You undertake not to engage in any misconduct that could result in harm or liability to the MyLingoTrip platform and its affiliates, partners, and employees.

9. Language Teachers – Compliance with Booking Procedure

All registered language tutors must adhere to the designated booking procedure on our website. Engaging in or promoting any activity that involves arranging lessons with a language student outside of MyLingoTrip is strictly prohibited under our terms and conditions of service. The following activities are specifically not permitted:

Communicating via email, Skype, or any other means to schedule and arrange a lesson with a language student with the intention of avoiding the payment of the booking fee to the MyLingoTrip website.

Any registered language tutor found in violation of these terms and conditions, particularly those who privately arrange tuition time with a MyLingoTrip language student to avoid the booking fee, may face the following consequences: Termination of cooperation between the MyLingoTrip platform and the language tutor involved in the prohibited activity. Exclusion of the particular language student from their rights to use the MyLingoTrip website in the future. Possible legal action against the language tutor, language student, and/or their parent or guardian.

 

 

10. Language Teachers – Delivery of Language Training Services and Registration

Registered language teachers at MyLingoTrip are expected to deliver high-quality language training services to all registered language students in a prompt manner. The required standard of service may be subject to change, and MyLingoTrip reserves the right to implement such changes as necessary. During the registration process as a language teacher, you will be required to provide personal information. Additionally, you will be requested to provide your new MLT Skype ID (username) and password to the MyLingoTrip administrative team. Depending on students’ needs, another option is to create a new Zoom, G. Meet, or WebEx account, just for MLT usage.

Note 1: MyLingoTrip does not assume responsibility for the quality of the Skype/Zoom/etc interface or the communication quality between users utilizing such Apps). 

Note 2: All options are temporary, since in the future, all lessons will be delivered throughout our platform, without having the need to use any external applications that may interfere with the quality of lessons (due to lags, bugs, and other issues with the free versions of those Apps).

 

 

11. Your Rights

MyLingoTrip grants you a non-transferable, non-exclusive, limited right to access, use, and view the content on this platform, subject to your compliance with this Agreement and the Terms as outlined in their entirety. The materials available on this site are provided exclusively for your personal, non-commercial use. Certain services offered on this site are accessible solely to registered customers of MyLingoTrip.

By purchasing a subscription or register for a Free Trial Lesson of MyLingoTrip, you agree to be bound by the terms and conditions as set out in full.

12. Privacy and Security Policy

Your usage of our Site and any personal information or other data collected about you by mylingotrip.com through or in connection with the Site is governed by our Privacy and Security Policy. We prioritize the protection and confidentiality of your information. If you have any inquiries regarding our online privacy and security policy, please direct them to our administration team.

Note: We will never share your data with third parties, even if they provide services on our behalf, unless you give us permission to do so.

13. Impart Among Users and Termination of Account

MyLingoTrip maintains the following policies regarding user interactions and account termination: 

Communication Monitoring: MyLingoTrip reserves the right to monitor communications between users. By using any of the communication functions provided on the platform (such as Skype, Notes, G-mail), users consent to the supervision of their communications. This monitoring is in place to protect the integrity and security of mylingotrip.com, prevent user abuse, detect fraud, and ensure compliance with our fee structure.

Language Tutor Account Termination: Language tutors may choose to close their accounts by providing at least two (2) months' notice to MyLingoTrip's administration team before ending their engagement. However, such closure is subject to the completion of any outstanding or unresolved lessons. Language tutors must notify both MyLingoTrip's administration team first, and afterward their students about their intention to close their accounts. MyLingoTrip will take necessary steps to transfer the students to another language tutor who can meet their needs and availability slots. 

Language Student Account Termination: Language students have the right to close their accounts at any time. However, they remain liable to MyLingoTrip and any language tutor for any unpaid lesson fees incurred prior to account closure.

14. Applied Laws, Regulations, and Jurisdiction

These terms and conditions shall be regulated in all respects by the laws of Greece without affecting any principle that may require the application of the law of another jurisdiction. The arrangements of this agreement are severable and you agree that any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Greece. Concequently, you herewith submit to the personal jurisdiction of the courts located in Greece for prosecuting or litigating such disputes or claims. Any cause of action you may have in regards to MyLingoTrip must be commenced within one month after it arises, or the cause of action is repudiated.

15. Miscellaneous

In the event that any portion of this Agreement is deemed unlawful, void, or unenforceable by an arbitrator or a court of competent jurisdiction, it shall not render the Agreement as a whole unlawful, void, or unenforceable. Only the specific portion of the Agreement that is deemed unlawful, void, or unenforceable shall be removed. You acknowledge that if MyLingoTrip chooses not to exercise or enforce any legal right or remedy stated in the Agreement (or any right or remedy afforded by applicable law), it shall not be considered a formal waiver of MyLingoTrip's rights, and such rights or remedies will remain available to MyLingoTrip.

All covenants, agreements, representations, and warranties made in this Agreement shall continue to be valid and effective following your acceptance of this Agreement and the termination thereof.

This Agreement represents the entire understanding and agreement between the recipient and MyLingoTrip and supersedes and replaces all oral or written agreements concerning the subject matter hereof.
